Researcher Abdul Latif Hamoud Muhammed Almousheki has been awarded a Doctorate degree in Civil Law from the Faculty of Sharia and Law at Sana’a University for his dissertation titled “Formality and its Effect on Contracts in the Yemeni Law: A Comparative Study,” on Thursday, 17\/11\/1446 AH, corresponding to 15\/5\/2025 AD.<\/p>\n

The Viva voce committee consisted of:
\n* Prof. Abdullah Ali Alkheyari, Supervisor.
\n* Associate Prof. Muhammed bin Hussein Alshami, External examiner.
\n* Associate Prof. Ma’amoun Ahmed Alshami, Internal examiner.<\/p>\n

The study aimed to consolidate the scattered concept of formality found in various branches of law within a unified objective framework, making it easily accessible to specialized researchers. It also aimed to draw the attention of specialists to the importance of this issue and encourage them to develop a precise understanding of the advantages and effectiveness of formality, hoping to facilitate its potential use in any legislative reform related to this aspect.<\/p>\n

The thesis concluded with the following findings:
\n* Formality is a flexible legal concept that can contribute to the stability of transactions, the preservation of rights, and the facilitation of access to justice.
\n* Formality reinforces the element of consent and protects the will, and it does not contradict the freedom of expressing one’s will.
\n* There are some shortcomings in certain legal texts related to formality, particularly the formality of official documents.<\/p>\n

The study recommends the following:
\n* The Yemeni legislator should mandate official written form as a requirement.
\n* The witnessed written form should be mandated for the proof of marriage contracts.
\n* Amendment of Article (100) of the Yemeni Law of Evidence.
\n* Clear and detailed regulation of the method of challenging the authenticity of official documents.<\/p>\n

The discussion was attended by a number of academics, researchers, students, interested individuals, as well as colleagues of the researcher and members\u00a0of\u00a0his\u00a0family.<\/p>\n
