Doctoral Degree Awarded to Researcher Ghada Abdelwahab Saleh Al-Jaradi from the Private Law Department, Faculty of Sharia and Law.
Researcher Ghada Abdelwahab Saleh Al-Jaradi was awarded a PhD from the Private Law Department, specializing in Civil Law, at the Faculty of Sharia and Law, Sana’a University. Her dissertation, titled “Partition of Common Property in Yemeni Civil Law No. 14 of 2002,” was successfully defended on Thursday, January 19, 2024.
The dissertation committee consisted of: Assoc. Prof. Mohamed Hassan Al-Shami (External Examiner and Chairperson).

The dissertation aimed to investigate the final partition and outline the legal procedures to be followed in partitioning common property. It also provided a comprehensive study and analysis of the legal provisions governing partition in the Yemeni law, comparing them with Egyptian, Algerian, Palestinian, and Islamic jurisprudence.
The dissertation came out with several conclusions, including that the most common reason for the emergence of co-ownership is inheritance, which often leads to disputes among co-owners from the same family, causing family breakdowns. In response to this problem, the Yemeni legislator has sought to provide alternative solutions to exit co-ownership through a partition request.
The researcher presented several recommendations, including amending Article 1221 of the Yemeni Civil Code to specify a five-year period for spatial partition, automatically renewable, and to consider judicial partition before conducting the final partition.
The defense was attended by academics, researchers, students, interested parties, as well as the researcher’s colleagues and family members.
