Public PhD Viva-Voce Examination of Mr. Abdulwahab Mohammed Ahmad Abdulqader, from the Department of Islamic Studies, Faculty of Arts & Humanities – Sana’a University
Mr. Abdulwahab Mohammed Ahmad Abdulqader has successfully awarded a PhD from the Department of Islamic Studies, Faculty of Arts & Humanities – Sana’a University, majoring in Sharia Policy. His dissertation, entitled “International Protection of Refugees and Migrants: A Comparative Study Between Islamic Sharia and International Legislation: Yemen as a Case in Point,” was defended on Wednesday, Rajab 22, 1446 Hijri, corresponding to January 22, 2025.
The Viva-Voce Committee, which was formed based on a resolution issued by the Post-Graduate Studies and Scientific Research Council, consisted of the following:
1. Prof. Mohammed Yahya Al-Makhdi, Main Supervisor, Sana’a University, Member.
2. Prof. Ahmad Ibrahim Yahya Yabes, External Examiner, Al-Hodeidah University, Member.
3. Prof. Huda Ali Yahya Al-Imad, Internal Examiner, Sana’a University, Chair.
The primary objectives of the dissertation were to elucidate the rules governing international protection in relation to those established in Islamic law, to analyze the shortcomings and foundational principles associated with the rights of refugees and migrants, and to investigate the factors contributing to the failure of such protections. The research sought to achieve a balance between positive legal texts and the specificities inherent in Islamic law while proposing a contemporary model of legal solutions.
In his findings, the researcher identified several critical conclusions, notably that the inadequacy of international protection stems from states’ failure to meet their international obligations. He posited that international protection represents a dynamic extension of legal frameworks that have established practical guarantees and objective solutions for safeguarding refugees and migrants. Additionally, he emphasized that Yemen requires a series of supportive measures to effectively address the circumstances faced by these populations.
The researcher also articulated several recommendations at Islamic, international, and national levels, advocating for the activation of legal protection mechanisms and the incorporation of contemporary practical measures aimed at ensuring comprehensive protection for refugees and migrants.
The Viva-Voce was attended by several academics, researchers, students, and several colleagues and family members of the researcher.
